THIS TEXT COULD PROVE HEAVY (BUT INTERESTING) READING.
This text has been dictated to me, Harv, by the PriSoner on the date
mentioned. Been on da phone ages, me ear hurts :)
My apologies for this text being a bit on the serious side, i have
included all the detail i can remember but obviously it was a very
stressful time for me but i have tried to keep it as informative as
possible. All you sysops out there should find this text interesting
and be able to gain some help from it in case the same happens to you.
I also apologies for this text being a few days late but obviously its
been a stressful time and i've had a lot of things to sort out and
arrange.
ABOUT THE BUST
2.30ish PM 13th July Thursday. On the phone to Harv when the doorbell
rang i asked him to hold on so i could answer it when i answered the
door i saw a plain looking couple with papers in there hands. Reaction
was Jehovah's Witnesses, oh shit... A search warrant was shoved in my
face. I was told it was for stolen computer equipment. Before I knew it
the house seemed to be full of plain clothed police officers i was
ushered into my computer room, one of them noticed the phone was the
hook and asked me who i was speaking to, i replied no one just a friend
and hung up. At that point I was cautioned about my rights and asked
what the program on the screen was.
PriSoner: I replied Directory Opus.
Police: He asked me what it does.
PriSoner: I told him.
Police: He asked me weather the program could talk to other computers.
PriSoner: I said no.
Police: He then said can I talk to other computers with my computer.
PriSoner: I said yes.
Police: He then asked if other computers could talk to my computer.
PriSoner: I said yes.
Police: He then asked if I ran a bbs.
PriSoner: Again I said yes.
Police: He asked if the bbs was run by me.
PriSoner: I said no, it was run by the users and i would like to speak to a
solicitor before i answer any more questions.
Police: To that he arrested me for trademark and copyright offenses, he then
PriSoner: called in soco, to take photographs, throughout i was unable to go
near the computer. Two hours later, once most of the computer equipment
had been haled off into the van, I was escorted to the police station,
charged, had a duty solicitor called and stuck into a cell for another
three hours.
Then the duty solicitor arrived, he asked me for my personal details,
so the fat lazy bastard could claim lots of dosh for sitting there and
saying nothing. (My advice to you would be to make sure you know a
solicitor cos the duty solicitors are CRAP!).
Anyway, i told my solicitor that they were only interested in the
software/ bbs and had lied about the reason for obtaining a search
warrant. His attitude was they could do what they want and get away
with it, very unhelpful.
THE INTERVIEW
After the formalities were over, tapes being set and names spoken over
the tape etc. I was arrested again this time under the offense of
handling stolen property. They asked me various questions about where i
had obtained the goods in my house etc. to which i kept replying that i
bought them that i was under the impression that they were obsolete
second hand goods I didn't know the people i bought them off. This may
not have sounded like a very good excuse but they have no choice but to
accept it as they have no proof to the contrary. They then, after only
5 minutes of questioning about stolen hardware ?! moved onto the bbs
and software, my basic line through this questioning was the bbs was
run by the users, for the users, i had in the past spotted copyright
software on it but had deleted it and either deleted or warned the
user, but at the end of the day i could not watch the bbs 24 hours a
day and didn't have time to check every piece of software. After about
90 minutes of the same thing, lots of repetition and 1 break, they
excepted my story and moved onto a couple of quickies about weather i
had ever used 0800 numbers, mobile phones and had my computer connected
to the satellite system. etc. All of which i replied no to. Nothing more
was said about each subject. During the course of the interview, he
said that on 'INFORMATION RECEIVED' he'd been told that my bbs was being
used as a distribution point fir trademarked and copyrighted software.
At which point my face lit up a bit. I waited for a couple seconds for
my CRAP duty solicitor to step in, but he didn't :( so I said that the
warrant was for stolen computer equipment, at which point he seemed to
get fairly techy and defensive, he tried to explain/make out that they
had accidentally come across the bbs, he had previous experience with
this sort of thing, (Even though Dopus was on the screen and has
nothing to do with comms) and he kept trying to emphasize the point
that they had accidentally found the bbs, even though on tape, he had
said he was ACTING ON INFORMATION RECEIVED. This banta went on for
about five minutes with him on the defensive, at which point i said,
'Yeah whatever you say', at which point the interview abruptly ended.
I was then bailed to appear at the police station in two months on
the charge of Handling Stolen Property (they never mentioned dropping
charges of trademark and copyright offenses, but they must have as it
is not on the bail sheet). Thats about the basic story of what happened
on the day.
CONCLUSION
I have obviously been informed upon due to what he said in the
interview of running a bbs, i have a very good idea as to who grassed
me up. I cant be 100% certain, but i'm 99.9% certain, read on to find
out who and my reasons for believing that's he's the culprit and you can
make up your own mind. Also make sure you know of a solicitor or two
just in case this should happen to you, as my duty solicitor said
absolutely nothing throughout the entire interview, apart from at the
end in private when i again pushed the possible illegality of the
warrant and emphasized the fact that the police officer had said on
tape that he was acting on information, at which point he said 'err,
um, err', now you come to mention it, hehe, you may have a point, ill
have to check it up, something which he shouldn't have to do! Also, any
rings at the door, any knocks, make sure the computer screen is turned
off (The computer May stay on) as with no information on the screen it
will make them a lot harder to ACCIDENTALLY find a bbs. Also another
thing to think about is The Ploice which concerned themselves with this
bust were South Yorkshire Police, they come to West Yorkshire for stolen
equipment. I Think not :\..
SUSPICIONS
At the moment, everything points to Jr. Sysop of Dallas BBS and Leader
of data division, as being the one who informed, the reasons behind
this are:
1. He owes me, butch, captain kirk, jacko and god knows who else a
cash/guts and has done for a while. This would give him a reason for
not wanting me to stay around.
2. He has been very closely connected to the recent pbx/cc/cd busts
which paranoia around the scene a coupla months a go, he was connected
with Kittaro being know as one of the major grasses in that instance
and yet although he was very well informed about the whole thing, he
lives a stones throw away from Kittaro was unscathed by the whole
thing, as such he would know who to contact as just phoning the police
would get a response.
3. There had recently been a textfile written by a trader called
--AleX -- called 'DAT-CRAP.TXT' Jr. EALLED a msg on his bbs accusing me
of being -- AleX -- and that he was going to release a reply with 'The
Truth' in it, he also deleted Librarians Account, accusing him of
giving me a capture of his bbs when in fact it was a Data Division
member Hahahahahah, I rang Jr. the following day asking where this 'Truth'
reply was, i also said what are you gonna actually say that Data
division releases are actually good Hahahahahahahaha, he seemed very
happy, he replied 'That's between me and the Garden Shed!!!!'.
This whole thing seems a bit too much of a coincidence that i should
get bust a couple of days after a text release that Jr. accused me of!
Make up your own minds, but in my humble opinion the only person with
the contacts and a sufficient reason is Jr.!!!
As things stand at the moment, I haven't one piece of computer equipment
in my house, they've taken everything, including all papers, documents,
postal receipt, details connected with the computer. I WILL BE GETTING
90% of what was taken BACK. But as to how long its going to take I have
no idea, obviously a good solicitor will be able to get it back for me
a lot quicker, I will be back very shortly so don't delete my accounts,
just drop me to newuser level and change my password, when i have the
ability to call i will let you know what password to use and to
reactivate my account. I've currently been offered loans of computers of
various people but am currently lacking a screen and a modem. Anyone
with a spare screen or modem that would like to contribute, any loans
would be appreciated. :) Grovel Grovel, Beg Beg :) The Village BBS will
be back as soon as i get my equipment back, with original account
details, inactive accounts will have been deleted and security will be
tighter. This could be anything from a couple of weeks to 5 or 6
months, so hang in there cos the Village will be back.
